1. Eligibility

You must be at least 13 years of age to use the Platform. If you are between 13 and 18, you may only use the Platform with the consent of a parent or legal guardian. By using the Platform, you represent that you meet these age requirements.

2. User Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must provide accurate and current information when registering. You may not create accounts for others without their consent, operate multiple accounts for abusive purposes, or share your credentials with third parties.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent behavior, or compromise Platform security.

3. Community Conduct

You agree not to post, upload, or share content that:

• Is unlawful, harmful, threatening, abusive, harassing, defamatory, hateful, or discriminatory
• Contains spam, unsolicited commercial content, or unauthorized promotions
• Impersonates another person, entity, or The Other Traveler staff
• Includes malware, phishing links, or other malicious code
• Violates the privacy or intellectual property rights of others
• Constitutes misinformation designed to deceive or manipulate

We enforce a zero-tolerance policy on hate speech targeting any protected characteristic including race, ethnicity, religion, gender, sexual orientation, disability, or national origin.

4. User-Generated Content

You retain ownership of content you post on the Platform. By submitting content, you grant The Other Traveler LLC a worldwide, non-exclusive, royalty-free, sublicensable license to host, display, distribute, reproduce, and adapt your content for the purpose of operating and promoting the Platform.

You represent that your content does not infringe the intellectual property rights of any third party and that you have all necessary rights to grant this license.

We reserve the right to remove any content that violates these Terms or applicable law, at our sole discretion and without prior notice.

5. Editorial Content

Content published by The Other Traveler editorial team is provided for informational purposes only. Travel information, safety assessments, cost estimates, and destination guides are subject to change and may not reflect current conditions. Always verify critical travel information through official sources before making decisions.

6. Intellectual Property

The Other Traveler name, logo, design system, and all original platform content created by our team are the intellectual property of The Other Traveler LLC, protected by copyright and trademark law. You may not reproduce, distribute, or create derivative works from our proprietary content without written permission.

7. Advertising and Sponsored Content

The Other Traveler displays third-party advertising through Google AdSense and may work with advertising partners on sponsored content. All commercially influenced editorial content is clearly labeled as such. We do not endorse or guarantee the products or services of our advertising partners.

8. Third-Party Links

The Platform may contain links to third-party websites. We are not responsible for the content, privacy practices, or terms of third-party sites. Links do not constitute endorsement.

9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR UNINTERRUPTED AVAILABILITY. WE DO NOT WARRANT THAT THE PLATFORM WILL BE ERROR-FREE OR THAT ANY CONTENT IS ACCURATE, COMPLETE, OR CURRENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE OTHER TRAVELER LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM.

Our total aggregate liability for any claim is limited to the amount you paid us, if any, in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless The Other Traveler LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Platform, your content, or your violation of these Terms.

12. Termination

We reserve the right to suspend or permanently terminate your access to the Platform at our discretion, with or without notice, for violations of these Terms or any reason necessary to protect the Platform or its users. 13. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

14. Governing Law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law principles. Mandatory provisions of your local law may apply for users outside the United States.

15. Dispute Resolution

Any dispute arising from these Terms will first be addressed through good-faith negotiation. If unresolved within 30 days, disputes will be submitted to binding arbitration under applicable arbitration rules, except that either party may seek injunctive relief in a court of competent jurisdiction.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by updating the "Last updated" date at the top of this page. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
